Dodgy Dealer or could I be wrong?

I went to trade in my CH lancer the other day, and told the dealer it was a 2007 model, as it was sold to me. I didn't check the compliance plate when I purchased it, but it has compliance date 03/06 and was manufactured 12/05.

I went back to the pinkie from when I purchased the car, and both that and the sales contract/invoice state manufacture year of 2007.

Now I know things can get confusing when cars are released ahead of time, ie MY07 models released in the second half of 2006, but there is no way that with the dates mentioned above that this car can be considered a 2007 manufacture right?

Has anyone else had any similar situations? I am going to look for some compensation for selling me a car under false pretences as the trade in value of the car is now less than it would be as a 2007 model, would be interesting to see if other people have been through similar things.
 
I think so. Considering it is a $5k fine for incorrect particulars on a pink slip (and this seems to be a pretty cut and dry case), I think the dealership has some answering to do to avoid me taking them to court. Hopefully they will settle before getting to that stage to avoid the fine, attention from the MTA and legal costs.
 
my07 manufactured september 06 I think, dealer had it listed as my06... they aren't very bright, they also told me it was the 2.0 not the 2.4, I popped the bonnet, saw mivec and thought hmm, no worries.

Dealers are pretty dumb in general, you may find you don't have much recourse though, check what it was listed on your sales contract as, if you don't have it, you're probably out of luck
 
Even if they do, I will take them to court if I have to (pending legal and dept. of consumer protection advice tomorrow). I am just hoping they they see the sense of not paying a $5k fine, plus any compo a court may award, plus the time and other factors which are required for court. I don't really want to spend the time either, but I wont let the Big Man win :)

Dealer said mine was 2 litre aswell. Dont know about the year manufactured though. Seems like a pretty serious jiff to me
 
07 is classed as from july 1st 06 to june 30 07. it is the same as your tax.
its the same as my wagon it was made september 92 but is is a 93 model car.

yours would be classed as an 06 model going off the date of manufacture
 
the info on the pink slip is what's recorded with the rta. so good luck taking them to court ya kidding your self if your going to get any where with that.
And really if you think someone should pay you compo of some sort because you didn't check the particulars before you handed a big amount of cash your not to sharp upstairs imo
Do the free rego check on the rta website and it'll show you what they have recorded. i presume your nsw but I'm sure other states have the equivalent .
And if your going to try extortion on a car dealer you'd prob be better keeping it to your self and not posting it on an open internet forum. You might be better off going through the right channels as you don't know who it is your try to extract some cash from, they might not take to kindly so some keyboard warrior threatening them so again same as when you purchased your car it might pay to use your head or at least try to first.
 
When I ordered custom plates the other day I noticed on my rego it says my car is a sedan when it's clearly a coupe. Lol dealers have no idea

The pink slip is handwritten, so there is no guarantee that it is what is recorded with any authority

I expect compensation because I was sold a good which is not as it is described, not because I didn't check, there is a clear difference. Not everyone is a "tech-head", which is why I had a mechanic check the car over before purchase. The mechanical check and the purchase were two separate activities, in hindsight probably an oversight.

I can't recall saying I was going to try extortion on the dealer. All I said is that I would take them to court, which is a legal right considering they have broken the law. I would rather things didnt get to that stage, I feel that it would be pointless for both parties, something which I have also stated.

I clearly stated that I was going to get legal advice and advice from consumer protection. Who do you consider to be the right channels? The guy from consumer protection agrees with me 100% that there is course for action and that I should try and settle with the dealership before taking the action any further.

I can't recall asking your opinion on this. I am pretty sure if you were sold a car under false pretences (no matter what they were) you would be looking for some form of retribution.

How about we keep to the question I asked and keep the personal insults out of it?
 
mmc77 pretty much said to you straight, what everyone was thinking. it doesn't matter what state you're in, similar checks exist, as he said and you ignored.
The right channels? you're effectively squabbling over a couple of hundred dollars in regards to resale value.
I bought my my07 lancer for 8500 from a dealer, if it was my06 or my08 might have been 500 dollars purchase price difference, and likely not even that.

Expecting a dealer to know anything about a car they're selling is your first mistake, not checking yourself is your 2nd, coming onto a lancer forum you aren't a community member of, wanting to sell your car, then being annoyed when they tell you it's your own mistake is your 3rd.

What kind of compensation do you really expect? if you're hoping for money, picking fights, getting legal advice and talking about court over whats going to end up a couple of hundred dollars is a bit absurd.
 
oh dear this could go on all day couldn't it. Someone wrote a diy on how to buy a car the correct way,maybe you could have a read through that to save yourself any problems in the future and although you don't want my opinion which is strange because you've posted a thread in a public forum here's a life tip for you, the true mark of a man is when he learns to judge himself. In the simplest of terms that means if you *fudge* up, YOU must wear the repercussions.

At the end of the day, what mmc77 said was spot on. You're fighting a battle you've already lost. And lost at the point when you didn't do the BASIC credential checks.
Also, 1 year isn't going to overly effect the price of a car, there may only be $500 if that in difference in cost, and even then there are more variables that effect price then there are limbs to count them on on my body...

he was asking for advice and lets face it, we are all rooks at buying cars at some stage. advice can be given without calling him stupid.
